Two question abuout snap points in 3dsmax9 or higher

1 when I use pickpoint() with active snap ,many times i hit pionts where the marker is display ,but i can't snap any point .the problem is not exist in 3ds max 8

2 because above reason,I try mouse tool and can snap any piont,but the marker is stick to the location for the first click
How to make the snap marker move with mouse cursor?
